Rental T&Cs
1. The following rental conditions apply to all rentals by the “Owner” to each “Renter” unless otherwise notified in writing by the “Owner”. No variation or cancellation of any of these rental conditions will be binding unless agreed in writing by both parties.
2. The following terms and conditions must be accepted by the “Renter” before the “Owner” makes any flowers or services available to the “Renter”
3. The Owner reserves the right to change prices/special offers on the Website at any time without prior notice.
4. The rented flowers will at all times remain the property of the Owner. The Renter agrees to pay the Owner the rental charges for the flowers at the rates stated on the Website or on the rental invoice for the services specified in the contract. The Renter pays for the entire rental period of the flowers and not for the period of use of the flowers. The minimum standard rental period is 1 day.
5. A 50% deposit is required upon booking, at the time of signing the contract. Full payment of the rental price must be made no later than 2 months prior to the rental date and the rental is not considered confirmed until full payment is received by the Owner. If the booking request is made in less than 2 months prior to the rental date, a 75% deposit is required. Full payment of the rental price must be made no later than 1 month prior to the rental date and the rental is not considered confirmed until full payment is received by the Owner. The Owner reserves the right to cancel the reservation, retain the security deposit and re-rent the property if not paid by the scheduled date.
6. The Renter agrees to all additional charges and full payment of all additional transportation/delivery costs incurred and any additional rental fees and other charges incurred due to late return of the property and/or cancellation of the rental.
7. Where applicable, the Renter will be responsible for paying taxes in accordance with applicable federal and provincial legislation, unless otherwise stated in the contract.
8. At the discretion of the Owner and because of the fragile nature of the flowers, the Renter is required to pay an additional security deposit directly to the Owner prior to delivery. The minimum deposit amount is $250 or 50% of the rental price (whichever is greater). This security deposit may be used by the Owner as payment for lost, stolen or damaged property or any other related charges. The deposit must be paid no later than 15 days prior to the date of the event.
9. The Renter's liability for any lost, stolen or damaged flower will be the full cost of replacing or repairing the flower and will not be limited to the amount of the security deposit. If the flowers are recovered without damage, a full refund of the security deposit will be made to the Renter via bank transfer within 48 hours of the end of the rental.
10. A $100 administrative fee will apply to all reservations cancelled less than 30 days prior to the rental date. All reservations cancelled within 21 days of the rental date will incur 50% of the total rental amount (equivalent to the reservation deposit). Reservations cancelled within 10 days of the rental date will be charged 100% of the rental amount. In the event that the flowers are not available for pick-up on the rental due date, the rental rate will continue to apply based on the standard minimum rental rate for the rented flowers until they are picked up.
11. The renter accepts full responsibility for the flowers upon taking possession of it. The warranty period extends from the time of delivery to the time of pick-up. The renter is responsible for the replacement cost of any lost, vandalized or broken flowers. The renter is responsible for any damage to the flowers, including damage caused by bad weather and vandalism.
